A generic response strategy wastes time. The same 103 rejection can behave very differently depending on the examiner, art unit, claim type, and prosecution history.
Before you draft, ask the model to analyze the examiner’s behavior and tie that behavior to your next move. This helps you decide whether to argue, amend, interview, appeal, or prepare the client for another round.

Using examiner-level and art-unit-level data, tell me:

This prompt does more than ask, “What should we do?” It gives the model enough prosecution context to compare real options. That matters when the wrong next move could mean another office action, an unnecessary RCE, or avoidable claim narrowing.
Some interviews change the trajectory of a case. Others just add cost. Knowing when and if to interview is key.
The difference often shows up in examiner behavior. Does the examiner allow cases after interview? Do they respond better before an RCE? Do interviews help in that art unit, or only with certain rejection types?
Try this prompt:
Evaluate whether we should request an examiner interview for application [application number] before responding to the current office action.
Consider Examiner [name or ID]’s historical interview behavior, including allowance rate after interview, average number of office actions after interview, and outcomes compared with similar cases where no interview occurred.
Also compare this examiner’s interview outcomes to the broader art unit.
The office action includes [briefly describe rejection type, such as 103 rejection over references A and B].
Provide:
Keep the recommendation practical and tied to prosecution data.
This is where AI starts to support judgment instead of replacing it. The attorney still makes the call, but the call has context. That context is especially useful when a client wants to know whether an interview is a strategic step or just another cost line.

Claim narrowing can solve the immediate rejection and damage long-term value. That tradeoff deserves more scrutiny, especially in crowded art units or high-value portfolios.
Use AI to test the amendment before you make it. A strong prompt should look beyond whether the amendment can overcome the rejection. It should also assess claim-scope loss, continuation strategy, examiner tendencies, and the likelihood that argument alone could work.
Try this prompt:
Review the proposed amendment to independent claim [claim number] in application [application number].
Compare the proposed amendment against the current rejection, the cited prior art, the specification support, and the examiner’s historical treatment of similar amendments.
Tell me:
Provide three alternative response options.
For each option, include expected allowance likelihood, claim-scope impact, estimated prosecution cost, and risk of another office action.
This prompt fits the way prosecution decisions actually happen. You are not just trying to get allowed. You are trying to get allowed without giving away more than necessary.
Business development does not have to start with a cold pitch. For patent firms, some of the best opportunities sit inside public prosecution data.
A company may be struggling in a specific art unit. A competitor may be getting broader claims faster. A portfolio may show repeated RCEs, long pendency, appeal friction, or missed continuation opportunities. That is a much stronger conversation than, “We would love to learn more about your IP needs.”
Try this prompt:
Analyze [target company]’s U.S. patent prosecution activity over the last [3 or 5] years in technology area [technology area].
Identify business development opportunities for a patent prosecution practice based on prosecution performance, portfolio growth, examiner behavior, art unit concentration, pendency, RCE frequency, appeal activity, and competitor benchmarks.
Compare [target company] to [competitor A], [competitor B], and [competitor C] where relevant.
Provide:
Do not make generic claims. Tie every recommendation to a visible prosecution pattern.
This is the difference between selling services and showing relevance. Patent leaders do not need another broad pitch. They need a reason to take the meeting.
Clients ask the same hard questions. How much longer? How much more will it cost? Should we keep fighting, file a continuation, appeal, or abandon and redirect budget?
A good patent prosecution forecast helps the attorney answer with more than instinct. It turns prosecution history, examiner behavior, and art unit benchmarks into a clearer client conversation.

Use the application’s prosecution history, current office action status, claim amendments to date, examiner behavior, art unit benchmarks, and comparable application outcomes.
Provide:
Format the answer in two sections: attorney analysis and client-ready summary.
The client-ready summary should be direct, defensible, and suitable for inclusion in a status email.
This prompt helps prosecution teams translate messy procedural history into a practical recommendation. Firms can communicate strategy with more confidence. In-house teams can manage budget, timing, and portfolio decisions with fewer surprises.
Most AI prompts fail because they ask broad questions with thin context. Patent prosecution does not reward thin context.
Examiner behavior matters. Art unit patterns matter. Rejection type matters. Claim history matters. RCE history matters. Interview outcomes matter. Client business goals matter.
That is why the most useful AI prompts do not sound like “summarize this office action.” They sound more like this:
